Tax debt and collection

Before anything is paid, somebody has to read what is actually being claimed.

Assessment notices from the Agenzia delle Entrate and collection folders from Agenzia delle Entrate-Riscossione arrive with short deadlines, in a register that Italian taxpayers themselves find hard to read. The firm establishes what is claimed, what remains enforceable and what the realistic routes are. Where a lawyer is needed, that part comes from the partner law office.

The documents

Three pieces of paper that look alike and are not.

Italian tax debt reaches you through documents that resemble one another closely. Telling them apart is the first piece of work, because the sender decides who you are arguing with and the type decides what you are allowed to argue about.

An avviso di accertamento is an assessment. The Agenzia delle Entrate has examined a return or a position, concluded that more is owed, and must say on what grounds. This is the one stage where the merits are fully open: whether the income was there, whether the cost was deductible, whether the method used to reconstruct the figures holds up.

A cartella esattoriale comes instead from Agenzia delle Entrate-Riscossione, a separate body whose job is collection and not assessment. It gathers amounts already established elsewhere, including by your own unpaid return, and adds collection charges and interest. An avviso di intimazione is narrower still: the reminder that arrives when a folder has been sitting for more than a year, saying that enforcement is next.

Avviso di accertamento

Agenzia delle Entrate. Sixty days from notification to pay or to challenge. After that window it becomes enforceable on its own and passes to collection with no further document needed.

Cartella esattoriale

Agenzia delle Entrate-Riscossione. Sixty days to pay. The amount was established somewhere else, so the reading starts by finding where, and whether that earlier act was ever properly notified.

Avviso di intimazione

The collection agency again, and five days. It appears when a folder is more than a year old and it is the last document before enforcement. Nothing about it is routine.

Deadlines

The date of notification is worth more than the argument.

Every one of these documents starts a clock, and the clock runs from the date the document was notified to you, not from the date you opened it. That date lives on the envelope, on the postal receipt or on the certified email delivery receipt, which is why we ask for those and not only for the notice.

For a client living abroad this is the most expensive detail on the page. Notification can be validly made to an Italian address you no longer use, to a certified email box you never check, or by deposit at the municipality when nobody is found. The term runs regardless, so by the time the document reaches you in person a good part of it may be gone and the available routes have narrowed. The order of work is therefore fixed: first the deadline, then what remains enforceable, then the merits.

Sixty days

The ordinary term for an assessment notice and for a collection folder, counted from notification. Suspensions apply, including the August suspension of procedural terms, and they are counted rather than assumed.

Five days

The term on an avviso di intimazione. In practice the file has to be handled the day it arrives, and any plan has to be one that can be executed immediately.

Thirty days of warning

Before a vehicle is blocked or a charge registered on a property, a preliminary notice gives a short window to act. That window is where the least costly solutions still exist.

Autotutela does not stop the clock

Asking the office to withdraw an act it issued in error is often sensible and sometimes decisive, but it suspends nothing. The protective steps still have to be taken inside the original term.

Prescription

An old debt is not automatically a dead debt.

Italian tax claims do expire, and the period depends on the nature of the claim rather than on the document carrying it. State taxes such as income tax and VAT generally run for ten years. Social contributions to INPS, local levies such as IMU and TARI, and administrative fines generally run for five. A single collection folder can therefore hold items that are dead beside items that are very much alive, and treating the folder as one object is a mistake.

The other half of the rule is interruption. Each time a valid act is properly notified the period starts again from zero, which is why notification defects and prescription are always examined together. Reconstructing that chain is ordinary, patient work: obtain the debtor position from the collection agency, list each item with its origin and its year, and establish for each when it was last validly interrupted. The result is a table, and every later decision is taken from it.

Ten years, broadly

Income tax, VAT and the other state taxes, where a definitive act has formed. The long period makes the interruption history the decisive question.

Five years, broadly

Social contributions, local taxes such as IMU and TARI, and fines. These are the items most often found expired inside an old collection folder.

Interruption resets everything

A properly notified act restarts the period. A badly notified one does not, and that difference is frequently the whole case.

The debtor position

The full extract of what the collection agency holds against you, item by item and year by year. Nothing useful is decided before it is on the table.

Routes

Instalments, administrative measures and what enforcement looks like.

Where a debt is real and enforceable, the question stops being whether to fight and becomes how to carry it. An instalment plan, a rateizzazione, is the ordinary answer: plans commonly run to eighty four monthly instalments, with longer terms where the position justifies them and the documentation supports the request. Paying the first instalment generally stops new administrative measures, which is often the immediate objective.

A plan also has a failure condition, and it is strict. Once the number of unpaid instalments allowed by the rules in force is exceeded, eight under the current ones, the plan lapses. The whole remaining balance falls due at once, what has been paid is simply kept against the debt, and the same debt cannot normally be put into a new plan. A plan agreed at an instalment the client cannot sustain is worse than no plan at all, which is why the affordability calculation comes before the application.

The measures on the other side are administrative before they are judicial. A fermo amministrativo immobilises a vehicle, an ipoteca registers a charge against property above a statutory threshold, and beyond those sits pignoramento, the attachment of bank accounts, salaries and sums owed to you by third parties. Salary and pension attachments are capped by law, and the only home of a debtor who owns nothing else is protected from expropriation by the collection agency. These limits are real and usually unknown to the person they protect.

Rateizzazione

An instalment plan sized on what the accounts can actually carry. The first instalment generally halts new measures. Too many missed instalments and the whole balance returns at once.

Fermo amministrativo

A block registered against a vehicle, preceded by a warning notice with a short window. Contesting it afterwards is harder and slower than reacting inside that window.

Ipoteca

A charge registered on property once the debt passes a statutory threshold. It does not by itself force a sale, but it follows the property and surfaces at the worst possible moment.

Pignoramento

Attachment of a bank account, of salary within the legal limits, or of sums a third party owes you. The protections that exist have to be invoked, not waited for.

Judgement

When to challenge, when to pay, and when neither works.

Not every claim deserves a fight. A challenge costs money and time, and an assessment that is substantially correct is cheaper closed than argued. Equally, an act never properly notified, or resting on a reconstruction the office cannot support, or carrying items long expired, should not be paid because paying feels safer. The choice is an arithmetic one before it is anything else, and that arithmetic is what the firm produces.

Between the two sits autotutela, the request to the office that issued an act to withdraw or correct it because it is manifestly wrong. It is quick and cheap, and where the error is objective, a payment already made, a duplicated item, an identity confusion, it frequently works. What it does not do is suspend any deadline, so it is filed alongside the protective steps and never instead of them.

Where the total is beyond any realistic plan, Italian law provides over-indebtedness procedures for individuals, consumers and small businesses that fall outside ordinary insolvency. They run through a court with the assistance of an appointed body, they require a complete and honest reconstruction of assets, income and liabilities, and they can end in a discharge of what remains unpaid. They are a last resort and they are slow.

One boundary is worth stating plainly. The firm provides economic and accounting analysis and does not provide legal representation. Where a lawyer is needed, whether before a tax court, an enforcement judge or in an over-indebtedness procedure, the matter is handled by the law office of Avv. Paola Monaldi in Forlì, and the analysis prepared here is what that work is built on.

1

Read and date

Identify the act, the sender and the exact date of notification, and calculate the real remaining term including any suspension.

2

Reconstruct the position

Obtain the full extract from the collection agency, break it into items by origin and year, and establish what is still enforceable.

3

Cost the alternatives

Pay, instal, request in autotutela, challenge, or go to an over-indebtedness procedure. Each option costed, with its downside written down.

4

Act, and keep the calendar

Execute the chosen route inside the term, then hold the follow up dates. Plans and suspensions fail on missed dates far more often than on bad arguments.

Questions we are asked first

Before you write to us.

I received an Italian document I do not understand. How urgent is it?

Assume it is urgent until it has been read. Most Italian tax documents carry a term of sixty days from notification, and an avviso di intimazione carries five. We check the term before the merits, because a good argument raised late is worth less than a weak one raised in time. Send the envelope or the certified email receipt too, because the date of notification is on those and not always on the document itself.

What is the difference between an avviso di accertamento and a cartella esattoriale?

The avviso di accertamento comes from the Agenzia delle Entrate and is the assessment itself: the tax office says more is owed than you declared, and it has to explain why. The cartella esattoriale comes from Agenzia delle Entrate-Riscossione, the collection agency, and demands something already established, whether by an assessment, by a return you filed and did not pay, or by another authority. The first is contested on its merits. The second is usually contested on procedure, on prescription, or not at all.

They have put a fermo on my car and a charge on my flat. Can that be undone?

Sometimes, and the route depends on why it was possible. A fermo amministrativo on a vehicle and an ipoteca on a property are each preceded by a warning notice with a short window, and that window is where the cheapest solutions live. Afterwards the usual routes are an instalment plan, which generally stops new measures once the first instalment is paid, a request in autotutela where the underlying act is plainly wrong, or a challenge where there is a real defect.

Do you go to court for me?

No. The firm carries out the economic and accounting analysis: what is claimed, what remains enforceable, what has been paid, what the numbers should have been and where the file is weak. When a matter needs a lawyer we work alongside the law office of Avv. Paola Monaldi in Forlì, and that analysis is what the legal work rests on. Keeping the two roles apart is deliberate.
